摘要： 作为一个刑罚种类，财产刑既有其无可比拟的优势，也有其自身的不足。分析财产刑的利弊和实施方法就要对其在刑罚体系中地位进行合理的定位，合理设定适用范围；同时，适当改进执行方式，在贪利犯罪、过失犯罪、单位犯罪等犯罪中全面配置财产刑，充分发挥财产刑的优势。为利于财产刑的执行，我国应推行日额罚金制和罚金易科强制劳役或自由刑制度；应从法经济学视角全面评估财产刑制度设计的利弊，通过扬长避短的方式实现制度设计的最优化。

Abstract: As a kind of penalty, property penalty has its incomparable advantages and its own shortcomings. For property penalty, we must make a reasonable orientation for the status of it in the penalty system, and reasonably set the applicable scope of it; at the same time, we should appropriately improve the execution way of property penalty, and property penalty should be configured overall on corruption crime, negligent crime and unit crime to give full play to the advantages of it. For the benefit of execution of property penalty, day-fine system and criminal fine exchanging institution should be implemented; we should comprehensively evaluate the advantages and disadvantages of the design of property penalty system, and achieve the optimization of the system design by improving advantages and avoiding shortcomings from the perspective of law and economics.
