Abstract: With the expansion of asset management in trust industry, more business innovations have spoiled stable expectations for civil and commercial trials. As the common business, debates in judgment the trust of rights to return provoked are of typical analytic value. The particularity in trust of rights to return lies in different rules between trust property and traditional property. This essay returned to fundament principles, analyzed particularity of trust property in dual ownership, certainty of trust property, essential elements of establishment, and the solution of reforms in commercial judgment is paid more attention in practice area.
